1. Conclusion of the Travel Contract

a. It is only possible to book a trip online.

b. Following registration, the Principal will receive an invoice and/or booking confirmation from Diveandgo.com, containing the particulars of the Principal, the trip, the travellers, and the costs of the trip.

c. The Principal(s) has/have joint and several liability vis-a -vis Diveandgo.com for the fulfilment of all the obligations which arise from the registration and travel contract, both with regard to the Principal(s) himself/themselves and with regard to all the registered travellers.

d. The contents of the travel contract are based on the travel programme published by Diveandgo.com.

2. Payment and Return Policy

All payments must be made at the time of the reservation and via the various online payment systems. All our trips are compiled by the Principal himself. As a result, trips which are booked online are not subject to any return policy.

3. Total Travel Costs, Travel Time and Travel Programme

a. Unless provisions have been made to the contrary, the prices published in the programme are for one individual person.

b. The total travel costs are based on the prices, rates, airport taxes, fuel surcharges and exchange rates currently in use on the date on which the offer was made. Diveandgo.com reserves the right to pass on any interim increases in fuel surcharges (caused by fluctuating oil and dollar prices) to the Principal.

c. A change in any one of these elements may necessitate modifications being made to our prices. If the increase in the total price amounts to more than 10%, the traveller may cancel the travel contract without incurring any costs, subject to the condition that this cancellation takes place within ten days of the traveller being notified of the price increase.

4. Documents

a. The traveller must upon departure and during the trip  be in the possession of all the necessary documents, such as a passport, relevant visa/s, driving licence, green card and, if required, proof of inoculations and vaccinations.

b. If you book a diving arrangement other than a diving course for beginners, you must be in possession of a diving certificate, a log book, and a medical certificate which must not be more than a year old.

c. If you book a beginners course, then you must have a valid medical diving certificate.

d. Any consequences which result from a failure to comply with the above terms will be at the expense of the traveller and/or the Principal.

5. Travel Documents

The necessary travel documents will, under normal circumstances, be made available to the Principal approximately 48 hours after the reservation has been made but, at any rate, not until Diveandgo.com has received the total costs of the holiday.

6. Changes made by the Principal

Interim changes, including substitutions, may only take place in consultation with Diveandgo.com. The costs of any changes will amount to a minimum of € 45 per reservation and will be at the Principal's expense.

7. Cancellation by the Principal

a. The traveller may cancel his registration at Diveandgo.com completely or partially at all times. The corresponding costs per traveller are as follows: if a cancellation is made up to 28 days prior to departure: 35% of the total travel costs; from the 28th day (inclusive) up to the 14th day prior to departure: 50% of the total travel costs; from the 14th day (inclusive) up to the 5th day prior to departure: 75% of the total travel costs; from the 5th day (inclusive) up to the day of departure: 90%; in the event of a cancellation on the day of departure or afterwards: the total travel costs.

b. Different cancellation provisions may apply. This applies to all Live-aboards, Kri Eco, Sorido Bay, Lembeh, Murex, Galapagos, Belize, and Maratua tickets which are already printed and to any separate tickets. Rules may be subject to change.

c. If a traveller, or a number of travellers who have a joint booking for a stay in a shared hotel room, cancels, then this cancellation will be treated as a cancellation of the entire travel contract for all the travellers who would have shared this hotel room.

d. The remaining travellers will have the opportunity of entering into a new travel contract with Diveandgo.com, subject to the total travel costs listed in the travel programme. If this new contract pertains to the same period of time and the same accommodation, the cancellation costs which are due or which have already been received will be deducted from the costs of the new trip.

e. Cancellations may only be sent by email to: , stating the reservation number and with an accompanying explanation.

8. Cancellation and Changes made by the Tour Operator

a. The tour operator is authorised to cancel or change a trip if serious circumstances warrant it. This may be understood to mean circumstances which the tour operator was not aware of at the time of the conclusion of the contract and which had he been aware of them - would have constituted serious reason for him not to have concluded the contract. This includes, for example, a natural disaster, wars, strikes, force majeure or events which fall outside the tour operator's sphere of influence, such as a breach of contract by a hotel manager or the personnel responsible for organising the transport, etc.

b. The tour operator also reserves the right to cancel the trip without any compensation being due, if there is an insufficient number of participants.

c. If a cancellation has to be made because of any of the above situations, Diveandgo.com undertakes to make an immediate and complete repayment of any travel costs which have already been paid.

d. If changes to the date of departure, the time of departure, the travelling time, the transportation or the accommodation have to be made, then Diveandgo.com will immediately notify the Principal of the change in question and undertake to offer an alternative which is (at minimum) of equal quality.

e. If serious circumstances present themselves prior to, or during, the trip, then the tour operator may make any changes which he deems necessary, subject to the obligation upon him to limit any adverse effects on the traveller as much as possible.

f. If an overbooking occurs, the tour operator must offer an equivalent alternative in order to fulfil his part of the contract. The Principal is authorised to refuse the alternative trip (stating reasons), as long as this takes place by email within five days of Diveandgo.com making its offer. Furthermore, the tour operator is also authorised to offer another date, other accommodation or another trip from the programme, and to offset the difference against the original costs of the trip.

g. If notice of an overbooking is given after the trip has commenced, then the tour operator must immediately offer an alternative without increasing the costs of the trip.

h. If the tour operator does not offer the traveller an equivalent alternative, then he must offer him an amount of compensation, either in cash or in kind.

9. Liability of the Travel Organisation

a. When assessing whether a travel contract has been fulfilled or not, consideration must be given to the customs and habits of the country in which the services are provided.

b. Diveandgo.com is not liable for any damage which cannot be imputed to them, or for any damages which should not be borne by them according to generally accepted standards in the Netherlands.

c. If the damage is covered by travel and cancellation insurance, or if the damage is caused because of the Principal's or the travellers professional or business activities, then Diveandgo.com will also have no liability.

d. The travel organisation is not responsible for the cancellation of diving activities and the inconvenience and/or any damage suffered because of local (weather) and/or (political) circumstances.

10. Obligations and Liability upon the Traveller

Any traveller, whose personal behaviour is such that this endangers the proper execution of the trip or seriously hinders fellow travellers, will be excluded from further participation in the trip and the accommodation. All corresponding costs will be at his expense and he will not, under any circumstances, be entitled to complete or partial repayment of the total travel costs, unless the traveller in question cannot be held responsible in this regard.

11. Interest and Collection Costs

If a payment is overdue, the Principal will owe 1% interest over the amount for every month, or part thereof, that the payment remains forthcoming. Furthermore, he will be required to reimburse the extra-judicial collection costs, subject to a minimum of € 45,50

12. Calamities

If a calamity occurs during one of the trips/diving-related arrangements/excursions which is booked by you, then Diveandgo.com will have no legal liability whatsoever.

13. Complaints

a. If, despite all the care and effort taken by Diveandgo.com, a traveller still wants to lodge a complaint, then this complaint must be filed with the tour operators local representative at the trips place of destination. This representative will then endeavour to find a satisfactory solution.

b. If the traveller is not satisfied with the solution which is offered, he must file his complaint with Diveandgo.com in writing, including all the necessary documentation, within 14 days of returning to his home address. If the trip did not take place, then a period of fourteen days from the original date of departure applies.

Proof of preliminary registration involves either a so-called request reservation or any essentials which cannot immediately be confirmed by the tour operator. Legally speaking, the traveller is making an irrevocable offer to the tour operator and is consequently bound by this offer. Following acceptance of this offer by the tour operator, he is also bound by this offer. If a request to substitute a traveller is made, the Principal must guarantee that the other traveller(s) agree with the inclusion of the new fellow traveller(s).

If you have been given additional information about the accommodation, facilities or surroundings in hotel brochures, etc., then neither the booking agency nor the tour operator can guarantee the accuracy of this information. The description of the accommodation, facilities and surroundings in the tour operators publication or travel programme will be decisive.

If the insurance premium(s) has/have been completed, then this form, including the appendix, will also serve as proof of insurance. The participants will then be insured under the terms included in the appendix and as far as the trip is concerned for the combination indicated there. This proof of insurance must be submitted if a claim for damages is filed. Trips booked for Dutch consumers are covered by the guarantee issued by the Travel Compensation Fund (SGR) in accordance with the funds provided guarantee scheme.
